Table Of Contents For The Hearing Exhibits

The PUC case docket for my two complaints contains an entry for exhibits presented during the November 25, 2024 hearing.  Here is a link to those exhibits:  LINK

The contents of the exhibits are as follows:

The first five items are from my Trucking Complaint:

#1 - PDF page 4 is my Exhibit A.It is also Aqua’s Schedule C-1 showing operating expenses for their New Garden operation.Line 22 is for “Purchased Wastewater”.It shows $1,200,000 for all three categories of “Present Rates” through 3/31/2023.The source document was PDF page 662 of Aqua’s “Rate Case – Volumes 1 through 5”.  Here is a link to that filing: LINK

#2 - PDF page 5 is my Exhibit B.It is Aqua’s Schedule C-7.1 showing that the service provider for their “Purchased Wastewater Treatment Expense” is Brandywine Septic.The source document was PDF page 682 of Aqua’s “Rate Case – Volumes 1 through 5”.  See item #1 for the link to this document.

#3 - PDF page 5 is my Exhibit C.It is Marc Lucca’s letter to New Garden customers dated December 9, 2022.The key part is the statement s of this letter is: “After several months, we replaced hauling with a pipeline connecting the two treatment plants.” [emphasis added]  Here is an alternative link to that letter:  LINK

#4 - PDF page 7 is my Exhibit D.  It is PDF page 24 from Aqua’s 2021 annual report to the PUC for the year 2021.  It shows that Aqua’s pipeline activation project was complete by 12/31/2021.Here is a link to that report:  LINK   Here is an alternative link to the same report:  LINK

#5 - PDF pages 8 – 13 are the text of my trucking complaint as originally filed.

The next eight items relate to my consumption volume complaint.

#6 - PDF pages 14 – 19 are Aqua’s consumption volume filings.  Here is an alternative link to the same thing:  LINK

#7 - PDF pages 20 – 23 are my consolidation of Aqua’s consumption volumes (Same as: LINK)

#8 - PDF pages 24 – 25 validate the accuracy of the consolidation (Same as LINK)

#9 - PDF pages 26 – 29 detail the residential consumption volume issue.(Reference LINK)

#10 - PDF page 30 is a commercial sewer bill with a volume greater than 15,000 gallons.That disproved Aqua’s data showing that no commercial customer used over 15,000 gallons per quarter.

PDF page 31 is a table from New Garden tabulating use distribution by residential customers in New Garden.

#11 - PDF page 32 is Aqua’s consumption data from the 2/21/2020 Settlement Agreement that led to Aqua’s purchase of the New Garden system.The volumes are identical Aqua’s 2021 rate file, but predate the acquisition by 10 months.

​

#12 - PDF page 33 is my estimate of actual rate increase for New Garden customers.

​

#13 - PDF pages 34 – 50 are the text of my consumption volume complaint.

The remaining items are all Aqua’s Exhibits:

#13 - PDF pages 51 – 107 = Aqua’s Exhibit 1-G.  It is Aqua’s entire financial section for New Garden in 2021 rate filing.  Two key pages:

A) - PDF page 63 = my Exhibit A on PDF page 4.  It is the $1,200,000 annual cost.

​

B) - PDF page 83 = my Exhibit B on PDF page 5.  It identifies Brandywine Septic as the service provider.

​

#14 - PDF pages 108 – 287 = Aqua’s Exhibit 5-B.  There is mind numbing detail about cost allocations and how revenue would be derived.

#15 - PDF pages 288 – 289 = Aqua’s Exhibit A.  It is a copy of PDF pages 19 – 20 of the Recommended Decision for Aqua’s 2021 rate case.  Those pages summarize the input two neighbors and I gave at the November 12, 2021 public hearing for the rate case.  Here is a link to the RD:  LINK

#16 - PDF pages 290 – 801 = Aqua’s Exhibit B.  It is the entire 512 pages of the “Opinion and Order” for Aqua’s 2021 rate case.  Nothing directly addresses my complaints.

#17 - PDF pages 802 – 963 = Aqua’s Exhibit C.  It is Aqua’s May 23, 2022 compliance and tariff filing with the PUC.  This is the filing from which I discovered the consumption volume issue. 

​

#18 - PDF pages 964 – 965 = Aqua’s Exhibit D.  It is a letter from the PUC essentially accepting Aqua’s compliance and tariff filing. 

​

#19 - PDF page 966 – 995 = Aqua’s Exhibit E.  It is 30 pages of detailed revenue data from Aqua’s 2024 rate filing.  The source document is PDF pages 273 – 302 of Aqua’s volume 5 filing on 5/23/2024.  Here is a link to that filing:  LINK
